The United States Commodity Futures Trading Commission (CFTC) has declared a historic $17.1 billion in monetary relief for fiscal year 2024. This milestone highlights the agency’s continued efforts to regulate the cryptocurrency market. In particular, the relief comes from high-profile cases involving exchanges like FTX and Binance, resulting in record financial recoveries.
The breakdown consists of $2.6 billion in civil monetary penalties (CMP) and $14.5 billion in disgorgement and restitution. This demonstrates the CFTC’s firm commitment to maintaining market integrity, especially as the crypto space evolves rapidly.
FTX Case Drives Largest Recovery in CFTC History
A large portion of the recovery stems from the CFTC’s case against the now-defunct exchange FTX. The exchange’s collapse in November 2022 resulted in $12.7 billion in restitution and disgorgement, marking the largest recovery in CFTC history.
“FTX represents the largest restitution and disgorgement in our agency’s history,” said CFTC Chairman Rostin Behnam. “It highlights our dedication to holding wrongdoers accountable.”
In this settlement, $8.7 billion will go to the victims of fraud, while $4 billion in disgorgement will prevent wrongdoers from profiting. Notably, Sam Bankman-Fried, FTX’s founder, received a 25-year prison sentence in March 2024. However, the CFTC’s litigation continues, with additional proceedings against other key figures like FTX co-founder Gary Wang and former Alameda Research CEO Caroline Ellison.
Binance Settlement Strengthens CFTC’s Recovery Efforts
In another significant case, the CFTC reached a settlement with Binance, the world’s largest cryptocurrency exchange. Binance and its founder, Changpeng Zhao, were fined $1.35 billion. The CFTC recovered $150 million from Zhao, and the court also ordered Binance to pay the full $1.35 billion in civil penalties and disgorgement.
This case is part of the CFTC’s broader initiative to crack down on exchanges that break U.S. regulations.
Additional Crypto Cases Contribute to Success
Apart from FTX and Binance, the CFTC has taken action in other cryptocurrency-related cases. For instance, the agency charged former Voyager CEO Stephen Ehrlich with commodity pool fraud and registration failures. The court recently denied Ehrlich’s motion to dismiss the charges, and the case continues.
Additionally, the CFTC secured a summary judgment against Seneca Ventures, a fraudulent Ponzi-like crypto scheme. The court has ordered Seneca Ventures to pay $110.9 million in civil penalties, $83.7 million in restitution, and $36.9 million in disgorgement.
Moreover, the CFTC has acted against a defendant who used romance scam tactics to defraud investors of $2.3 million, intended for digital asset trading.
CFTC’s Ongoing Commitment to Protecting the Market
Chairman Behnam emphasized the CFTC’s ongoing dedication to protecting U.S. customers and overseeing critical markets. He pointed out that misconduct in crypto markets is rarely confined and that as technology advances, so too do the boundaries of regulatory oversight.
With crypto regulation evolving rapidly, these historic recovery figures underscore the CFTC’s key role in safeguarding the financial system as disruptive technologies continue to emerge.
