Elon Musk, along with Tesla and Warner Bros. Discovery, is facing a copyright infringement lawsuit regarding the use of an image from the film Blade Runner 2049 during a recent Tesla event. The suit, filed on Oct. 21 by Alcon Entertainment in a Los Angeles federal court, alleges that the trio used an AI-generated image after their initial request for a still from the film was denied.

According to the complaint, Tesla sought permission to use a still image from Blade Runner 2049 to promote its “Cybercab” at an event held on Oct. 10 at the Warner Bros. studio lot in Burbank. Alcon Entertainment claimed it rejected this request to distance the film from Musk’s “extreme political and social views.” Despite this rejection, the lawsuit alleges that Musk and his team utilized an “apparently AI-generated faked image” during the presentation.

Controversy Surrounding AI-Generated Content

This lawsuit highlights the ongoing legal battles surrounding AI-generated imagery and the copyright concerns that come with it. Alcon contends that a “lightly stylized fake screen still” depicting a character gazing at a devastated city was displayed during Musk’s presentation for 11 seconds. The complaint notes, “He had no credible reason” for including the image while discussing Tesla’s new product.

Alcon further claims that Warner Bros. Discovery has limited rights to Blade Runner 2049 and argues that these rights do not extend to a live-stream television feed. The company characterized the unauthorized use of the AI image as “a massive economic theft,” estimating the market value of the brand affiliation at “at least in the six “figures.” However, Alcon did not disclose the specific amount of damages it is pursuing.

Impact on Future Brand Partnerships

In addition to the copyright issues, Alcon expressed concern that the unauthorized image could jeopardize potential car brand partnerships for an upcoming Blade Runner TV series. The lawsuit stated, “Any prudent brand considering any Tesla partnership has to take Musk’s massively amplified, highly politicized, capricious and arbitrary behavior…into account.” This includes accusations of spreading misinformation and making inflammatory comments on his social media platform.

Musk’s recent activities, including rallies for Republican presidential candidate Donald Trump, have further complicated his public image. Alcon emphasized that it did not want Blade Runner 2049 associated with Musk or any of his companies, citing concerns over potential backlash from brand partnerships.

The Future of Tesla’s Cybercab

During the Tesla event, Musk promised that the Cybercab would be available “before 2027” and priced under $30,000. Despite years of anticipation surrounding Tesla’s self-driving capabilities, none of the company’s vehicles currently operate without human supervision.

As the legal dispute unfolds, it remains to be seen how this lawsuit will impact both Tesla’s plans and Alcon’s branding strategies moving forward.
