Grant Colthup, the former CEO of the Australian cryptocurrency exchange Mine Digital, faces serious fraud allegations for reportedly stealing $1.47 million (2.2 million Australian dollars) from a customer. This customer attempted to exchange their funds for Bitcoin but did not receive the cryptocurrency.

On Oct. 21, the Australian Securities and Investments Commission (ASIC) issued a statement outlining the case against Colthup. The ASIC claims that the customer paid $1.5 million to ACCE Australia, but the transaction ultimately failed to deliver the promised Bitcoin.

Allegations of Misappropriation

According to ASIC, Colthup allegedly misused the funds by either paying ACCE’s debts, purchasing cryptocurrency for other clients or a combination of both. This incident is not the first time Mine Digital has faced scrutiny. The firm went under in September 2022, leaving creditors attempting to recover $16 million from the failed exchange.

During a hearing at the Magistrates Court in Ipswich, Queensland, Colthup learned of the fraud charge on the same day as the announcement. The court has adjourned the case until Dec. 16, 2024. If found guilty, Colthup could be sentenced to a maximum of 20 years in prison under section 408C of Queensland’s Criminal Code 1899.
The Changing Value of Bitcoin

During the time of the alleged fraud, Bitcoin was trading between $18,890 and $24,580, based on data from CoinGecko. With Bitcoin’s current trading price around $67,460, the $1.47 million that could have purchased Bitcoin is now worth between $4 million and $5.24 million.

Mine Digital operated as a cryptocurrency exchange from May 2019 until its administration in September 2022. An initial investigation revealed that ACCE only had $20,000 in assets, a staggering difference from the $16 million claimed by creditors, as reported by the Australian Financial Review (AFR) on Oct. 13, 2022.

Ongoing Legal Actions

Following the collapse of Mine Digital, Brad Tonks, a Business Recovery and Insolvency Partner at PKF, was appointed as the liquidator for ACCE. By January 2023, reports indicated that PKF intended to sue Colthup. They sought a court order to hold him accountable for compensating creditors pursuing the substantial unpaid debt.

As the case progresses, the outcome may significantly impact not only Colthup but also the broader cryptocurrency landscape in Australia. It highlights the ongoing challenges and risks associated with digital asset exchanges.
