Pavel Durov, the founder of the popular messaging app Telegram, was questioned in a Paris court on December 6 regarding allegations that his platform facilitated criminal activities. The questioning started at 10 am CET, with Durov accompanied by his lawyers, David-Olivier Kaminski and Christophe Ingrain. Sources familiar with the case revealed that the legal proceedings focused on accusations of Telegram being used for illicit transactions.

Durov expressed confidence in the French justice system but declined to provide additional details to the media when asked about the case.

The Legal Case and Its Background

Durov’s legal troubles began on August 24 when French authorities temporarily arrested him at Le Bourget airport in Paris. He was later released on a $6 million bail, though his departure from France remains restricted until March 2025. French prosecutors have accused Durov of running a platform that allegedly enables illegal activities.

The preliminary charges against Durov were officially announced on August 28, which led to his arrest. If found guilty, he could face up to 10 years in prison and a fine of €500,000 ($550,000). The investigation into Telegram began in February 2024 and escalated to a judicial inquiry in July, just before Durov’s arrest.

Impact on Web3 and Privacy Concerns

Industry insiders have raised alarms about the broader impact of this case, especially regarding privacy-preserving technologies in the Web3 ecosystem. Vyara Savova, senior policy lead at the European Crypto Initiative, pointed out troubling similarities between Durov’s case and that of Tornado Cash developer Alexey Pertsev. She also noted the absence of EU involvement in these actions.

“The case against Durov is part of a troubling trend targeting developers of privacy-preserving technologies,” Savova stated.

In addition, Nikolay Denisenko, co-founder of the financial app Brighty, shared his concerns. He warned that the case could represent government overreach, with potentially severe consequences for digital privacy.

The 2017 Hacking Incident

Adding to the complexity of the case reports claim that Durov’s phone was hacked in 2017, a year before his meeting with French President Emmanuel Macron. This new detail further complicates the ongoing legal proceedings.

Broader Implications for Privacy and Crypto

The case against Durov has raised considerable concern within the cryptocurrency community. Many experts fear that it could mark the beginning of a wider erosion of privacy in Web3 technologies. They often refer to the arrest of Tornado Cash’s Alexey Pertsev as a concerning precedent.

However, there is some hope. In November, a U.S. court ruled that the Office of Foreign Assets Control (OFAC) overstepped its authority when it sanctioned Tornado Cash’s smart contracts. This decision provided a partial summary judgment in favor of the platform’s users, offering some relief to those worried about privacy in digital spaces.
